Applicant for Executive Assistant Position Claimed Job Offer Was Rescinded After Employer Learned She Was Pregnant

Olam Americas, Inc. agreed to pay $140,000 to settle a pregnancy discrimination lawsuit.  The company supplies and processes agricultural products and food ingredients.

The complaint alleged that a job applicant was denied a position as an executive assistant because she was pregnant.  The applicant was initially offered the position, but that offer was rescinded after she disclosed her pregnancy.  The lawsuit alleged that the company immediately offered the same position to another woman who was not pregnant.

It is illegal for employers to discriminate against women because they are pregnant, plan to become pregnant, or have a pregnancy-related medical condition.  The unlawful discrimination can take the form of refusing to hire, refusing to promote, firing, or taking other adverse employment action based on a woman’s pregnancy or plans to become pregnant.
