Under the False Claims Act, you can recover between 15 and 30 percent of whatever the government collects from the fraudster. If the government intervenes in your case, you typically receive 15 to 25 percent.
If the government declines to intervene and you proceed on your own, you can recover up to 30 percent. We’ve helped clients recover millions of dollars, including cases involving healthcare fraud, government contract fraud, and tax fraud.
The exact amount depends on several factors: the size of the fraud, the quality of your evidence, and your contribution to the case. New York’s False Claims Act also allows for penalties of $6,000 to $12,000 per violation, plus up to triple damages.
Multiple federal and state laws protect you from retaliation. The False Claims Act prohibits firing, demoting, harassing, or otherwise punishing employees who report fraud.
New York Labor Law Section 740 provides additional protections for reporting illegal activities or refusing to participate in them. If you face retaliation, you can recover double your lost wages, plus interest and punitive damages.

Time limits vary depending on which law applies to your case. Under the False Claims Act, you generally have six years from when the fraud occurred, but there are important exceptions.
New York Labor Law gives you two years to file retaliation claims. Some federal laws have much shorter deadlines – as little as 30 days for certain OSHA complaints.
The most important rule is this: act quickly. Once information about fraud becomes public, you may lose your right to file a claim and recover a reward. We’ve seen too many potential whistleblowers wait too long and lose their opportunity for justice.
You need credible information suggesting fraud occurred, but you don’t need to prove the entire case yourself. The government will investigate and can uncover additional evidence and witnesses.
What matters is that you have firsthand knowledge of potential fraud. This could include false billing records, altered documents, kickback schemes, or instructions to violate regulations.

False Claims Act cases are filed “under seal,” meaning they remain confidential while the government investigates. Your employer won’t know about the case during this period, which can last months or even years.
However, your identity may eventually be disclosed if the case proceeds to litigation. We work to protect your anonymity as long as possible and ensure you’re prepared for each stage of the process.
